These Terms and Conditions are the legal agreement between you and Thomas Plumbing, a Red Seal certified plumbing company owned and operated by Tyler Thomas in North Bay, Ontario. They cover how we quote, perform, warranty, and bill for plumbing work. By booking a service call, accepting a quote, or paying an invoice, you agree to these terms. Last updated 2026-05-17.
1. The Agreement
When you contact Thomas Plumbing to book a service call, request a quote, or schedule any plumbing work, you enter into an agreement with us on the terms below. The agreement starts the moment you accept a verbal or written quote, allow us to begin work, or pay any deposit or invoice. If you do not agree with any part of these terms, please do not book the work.
These terms apply to all residential and commercial customers, all service calls, all quotes, and all warranty claims. If you have a separate written agreement with us (for example, an ongoing commercial maintenance contract), that written agreement takes precedence where it conflicts with these terms.
2. Services Offered
Thomas Plumbing provides licensed residential and commercial plumbing services in North Bay, Ontario and surrounding communities. Our services include:
- Drain cleaning and camera inspection
- Sump pump installation, repair, and maintenance
- Pipe repair and replacement (copper, PEX, ABS)
- Bathroom and kitchen plumbing (faucets, toilets, sinks, tubs, showers)
- Electric water heater installation and repair
- Same-day emergency plumbing (weekday best-effort response)
- Commercial plumbing for schools, restaurants, marinas, and multi-unit properties
Water heaters: electric only. Thomas Plumbing installs and services electric water heaters only. We do not work on gas-fired water heaters or gas line connections. Gas work must be performed by a TSSA-certified gas technician, and we are happy to refer you to one.
Emergency service. We do our best to respond to emergency calls the same day during standard weekday working hours. We are not a 24/7 dispatch operation. After-hours and weekend response is offered when Tyler is available and is not guaranteed.
3. Service Area
Our primary service area is North Bay, Ontario and surrounding communities within a 60 kilometre radius, including Callander, Corbeil, Nipissing, East Ferris, Mattawa, South River, and Temagami. Work outside the 60 kilometre radius is reviewed case by case and may include a travel surcharge. We will always tell you up front if travel will be billed.
4. Quotes and Estimates
We provide both verbal and written quotes depending on the job. A quote is a firm price for a defined scope of work. An estimate is our best guess based on available information and may change once we open walls, expose pipes, or discover hidden conditions.
If we find additional work that needs to be done while we are on site (for example, corroded shutoff valves behind a vanity, or unexpected pipe damage), we will stop, explain what we found, and get your approval in writing or by text before continuing or before billing for the extra work. You always get to decide whether to proceed.
Written quotes are valid for 30 days from the date issued unless otherwise stated. Material costs can change without notice and we reserve the right to re-quote if pricing from suppliers has shifted materially.
5. Payment Terms
Payment is due upon completion of the job unless other terms have been agreed to in writing in advance. For larger jobs (new installations, commercial work, or projects exceeding $2,000), we may require a deposit before ordering parts or starting work.
Accepted payment methods: Cash, Visa, and E-Transfer. E-Transfer is sent to tylerthomas38@yahoo.com. We do not currently accept cheques except by prior arrangement with commercial accounts.
Late payment. Invoices unpaid 30 days after the invoice date are considered overdue. Overdue accounts may be charged interest at 1.5% per month (19.56% annually), and continued non-payment may be referred to a collection agency or filed in small claims court. The customer is responsible for any reasonable collection costs and legal fees incurred to recover the unpaid balance.
6. Warranty
Thomas Plumbing provides a 4-month labour warranty on all work we perform, starting the day the work is completed. If our workmanship fails within that period under normal use, we will return and correct the issue at no additional labour cost.
Parts, fixtures, water heaters, sump pumps, and other components are covered by the manufacturer's warranty, which typically ranges from 1 to 10 years depending on the product. We will provide you with manufacturer documentation on request and will help facilitate warranty claims with the supplier where reasonable.
What the warranty does not cover
- Damage caused by misuse, abuse, accident, or normal wear and tear
- Work modified, altered, or repaired by anyone other than Thomas Plumbing
- Damage caused by frozen pipes, flooding, lightning, power surges, or other acts of nature
- Pre-existing conditions that were not part of the original scope of work
- Failures caused by municipal water issues, well pump failure, or septic system back-up beyond the connection point we worked on
- Damage caused by chemical drain cleaners or other harsh substances introduced after we left the site
Warranty claims must be reported within the warranty period by phone or email and we will schedule a return visit as soon as reasonably possible.
7. Limitation of Liability
Thomas Plumbing is fully insured and stands behind its work. That said, the following limitations apply:
- We are not liable for pre-existing conditions discovered during a service call (for example, hidden mould behind a wall, corroded pipes outside our work scope, or code violations from previous work). We will document what we find and recommend next steps.
- We are not liable for indirect, consequential, or incidental damages, including but not limited to lost income, lost rental revenue, hotel costs, food spoilage, or damage to personal property unless that damage was caused directly by our negligence.
- Our total liability for any claim related to a job is capped at the amount the customer paid for that job. This is a standard trades-industry limitation and is intended to keep our pricing fair for everyone.
- We are not responsible for damage caused by acts of nature, third-party contractors, vandalism, or events outside our reasonable control.
Nothing in this section limits any rights you have under the Consumer Protection Act, 2002 (Ontario) or any other non-waivable consumer protection law.
8. Cancellation and Rescheduling
We understand life happens. Please give us as much notice as possible if you need to cancel or reschedule. Cancellations made the day of the scheduled appointment may be charged a callout fee to cover travel time and lost scheduling. Cancellations made the day before are typically no charge.
We may also need to reschedule on short notice due to weather, equipment issues, or a prior emergency call running long. If that happens we will let you know as soon as we can and rebook at the earliest available slot. We do not charge for our own rescheduling.
9. Customer Responsibilities
To get the job done right and on time, we ask customers to:
- Provide accurate information about the issue when booking
- Disclose any known issues with the plumbing system, including past repairs and DIY work
- Ensure clear access to the work area (clear out the under-sink cabinet, move stored items away from the water heater, unlock gates, etc.)
- Show us where the main water shutoff is located before work begins
- Keep children and pets away from the work area for everyone's safety
- Pay invoices on time per the agreed terms
If we arrive and cannot start work because access has not been provided or the site is not ready, a callout fee may apply.
10. Property Access
You authorize Thomas Plumbing and its team to enter your property at the scheduled time to perform the agreed work. For residential jobs we ask that the homeowner or an authorized adult be present at the start of the appointment so we can confirm scope, walk the site, and answer any questions. For commercial jobs, an authorized representative should be available to provide site access and approve change orders.
If you choose to leave the property during the job, we will continue working and document anything noteworthy with photos. You remain responsible for ensuring the property is safe and accessible for our team.
11. Photos and Testimonials
Thomas Plumbing may photograph completed work for our portfolio, website, social media, and marketing materials. Photos focus on the plumbing work itself, not identifying details of your home or family. We will never include your address, your name, or photos of children without explicit permission.
Opt out at any time. If you do not want your job photographed or featured anywhere, just tell Tyler at the start of the appointment or email tylerthomas38@yahoo.com at any time. We will respect that request, no questions asked, and remove any existing photos from public-facing channels we control.
12. Governing Law and Disputes
These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising out of or related to this agreement or work performed by Thomas Plumbing will be resolved in the courts of the Nipissing District in North Bay, Ontario.
Before filing any claim, we ask that you contact us first so we can try to resolve the issue directly. Most concerns can be sorted out with a phone call.
13. Changes to These Terms
Thomas Plumbing may update these Terms and Conditions from time to time to reflect changes in our services, pricing, insurance requirements, or Ontario consumer protection law. The current version always lives at thomasplumbing.ca/terms/ with a "Last updated" date stamped at the top. The version in effect on the day you book your service is the version that applies to that job.
